I-485 Birth Certificate RFE

Hello forum,

Although I did submit my birth certificate at the time of filing I-485,
I have received an RFE, which says " Submit the birth certificate of xxx. The birth certificate must be issued by the appropritate civil authority showing timely registration, date and place of birth, and parents' names".

Should I re-submit the one, which I submitted before or what to do? May be I will check with my lawyer if he forgot to include in my appplication but in the mean time if anyone has gottten same RFE with same experience, let me know.

-may be lawyer office did not sent the copy of BC. send the copy of BC to USCIS
 
"showing timely registration" on birth certificate means that the registration has to be done within one year of birth.

So I guess, you need to send your birth certificate and an affidavit from your parents with notary signature. (assuming that you got your birth certificate issued after one year of your birth date)

yes. I have that. Registration was done before completion of one year of my birth.

I have a english translated verion of my birth certificate, which includes
1)My name
2)Birth Date
3)Date of registration
4)Sex
5)Father's name
6)Mother's name
7)Authorized signature.

What else do I need? what you meant by affidavit from parents? Isn't what currently i have is enough?

Do I need to send copy of original language birth cetificate too along with english translated copy?

I'm not sure if this will help, but I was also asked for another birth certificate. I called the NSC customer service and I was explained what the problem was. In my country there are different versions of birth certificates (complete, abbreviated, etc). I submitted the abbr. one and they accept only the complete one. Maybe you can call them and get more info, too.

Information I mentioned in previous post,of what I currently have on birth certificate, do you think that's complete or abbrivated?

I think it really depends on the country. I'm from Poland and they told me that Polish birth certificate should include the hour I was born and whether my parents were legally married at that time. Again, they got this from some official blurb about Poland and they even gave me a Polish name of that particular birth certificate they want. They also told me where I can get it in Poland. I would call the customer service number and ask the person there what exactly you are supposed to send.

dont get confused .if they need any more info they will let you know. FYI birth certificates in India dont have Birth time and only date and are accepted by USCIS

Thanks guys for the info. I am going to send copy of original language BC along with english translated copy.

I will still need to go for Affidavit because my passport has my name as "namekumar" while birth certificate only has "name" no "kumar" so will have to affidavit explaning this is the same person (me). Any comments on this?
 
Birth Certificate Date and Name Spelling

Hi guys,

Saw this thread and I'm starting to worry about my Birth Certificate and Name Correlation.

Appreciate getting your help and insight...

My 485 still pending (filed Dec, 2005), and I-140 was just approved two weeks ago, so I'm waiting for 485 movement with TSC.

I was born in Ukraine (former USSR), and have citizenship (Passport) from another country.

My original birth certificate (written in Ukraine and Russian language) has actually 3 different dates:
- My Birth Date (say the date is X)
- The Date I was registered in the appropriate record of registrar office (X+2 months)
- The Date that the original Birth Certificate was issued: (x + 5 years)

Now, based on hr0803 posting if you have your registration done within one year of birth then no affidavit is required. The question is whether the related date is the registration or the actual issue of the BC?

Another potential problem I have is with my Name spelling. The Birth Certificate written in Russian, (I.e. non English characters). My Family name is identical to my parent's family name written on this birth certificate. However, I was translating my Family name to English differently from my parents, so my English family name spelling appear in my passport is different from my parents' passport.

To make it clear:
My Family Name in my Passport (in English) is: Yurbicamoskz (an example)
My Parents' Family Name in their Passport (In English) is: Yorbikamtzkch (an example)

Now, my translated (Notarized) Birth Certificate uses my and parents' name as they appear in our passports. So now, my family name spelled differently (I guess spelled means also different) from my parents family name. I guess looks weird ha?

Any ideas what to expect?

Should I prepare an affidavit?
Should this document be notarized?
Who should issue this document?
What should be written?

I guess it shouldn't be a problem
After all, you must have submitted your name in native alphabet on biographic data sheet. And what difference does it make if your parent's names are different? It happens ;)

but, again, it's INS, and logic doesn't work there
