I-485 bcis motion question

Hello.

My I-140 was denied by "hability to pay issues" in June 2004. This also denied my I-485, both I-140/I485 were filed concurrently on Sept 2003
Later my lawyer appealed and my I-140 got approved and my I-485 was reopened on a bcis motion on October 2004.

The message of my case on the BCIS page changed to the following:

Receipt Number: LINXXXXXXXXXXX

Application Type: I485, Application to Register Permanent Residence or to Adjust Status

Current Status:

On October 6, 2004, this case was reopened on a BCIS motion, and the case is now in process. It is taking between 570 and 600 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.


Is this really going to take that long???? My original receipt date is September 2003 and when I first filed my case I got the exact same timeframe of 570 and 600 days!!!!!

I doubt it will take a long time. You may want to check the processing times. But do take these with a grain of salt as your case may be adjudicated way before that. In my case, CSC was showing proc. date as June 2004, and mine was filed under EB1-EA in Dec. 2004. But I got an approval notice in the first week of Feb 2005. So worst case scenario ,you will be processed according to the time shown in the proc. times, and in the best case it will be, hopefully, much before that. Best luck!
 
I got the receipt with the same text but my case (485 denial) was approved in 4 days from the date of receipt. But every case is different. I had an approved I-140..don't worry, your case will be approved...it's a matter of time only.
