I-485 Based on Asylum

I am an Asylum Granted( 1998) and subsequently filed for Adjustment
of Status ( I-485) in 2001, after almost 4 years, they sent a notice
to do an I-693 and G-325 to my old address, unfortunately, I learn
everything after the due date was passed, Nov. 20/2005... I am in the
middle of processing everything for submission. I tried to talk to
USCIS Customer Service t Representative to extend the date that end up
in futility. My question, are they going to deny me based case for
merely it wasn’t submitted on time... after all it’s their fault to
send it to my old address, actually I did address change right before
I moved to my new place. What possibly happen to my case... I have waited so long to get to this point.... Please, any idea what to do??

Your agrument that the service was wrong may be correct or not. Many individuals who move out from address do their change of address and submit form RA11, and they wait. The problem with this is, this is legal requirement, and it does not change the addres on your applications. For example, If you submitted RA11 and move, the service centers normally would send any RFI to the old address. To avoid that it is good idea to call them at their 1800 number and make change of address orally once you file RA11. In this case, you should avoid both meeting the legal requirement for address change and not missing any information. If you did both of these, and the service send their RFI to your old address that is their fault, but if you submitted RA11 and you waited for the RFI to come to your new address it's your fault.
As far as your preparing documents now and the propects for denial, Nobody can tell you what they are gonna do about that. I were you I would have started from a zero. Submit an RA11, and change the address at their 1800 number, request for new FRI, and wait what happens. Once you do that they will talk. If they haven't sent you denial already, it is good sign and I don't think they are gonna deny. that is my gut feeling. I have seen many people who missed the request for evidence and once they told them that thye missed it the service sent them a new one. there was problem at all. so don't wait too much. just contact them...........good luck
