I-485 Aug Filer

Dear Folks,

I have been waiting for I-485 since Aug 2001. My details are below.

PD : June 2000
RD: 21 Aug 2001
ND: Oct 20 2001
FP: Feb 1, 2002
State : NJ , EB2

Now a days I do not see much posts in this forum about Aug approvals and see people posting about Sept 01 filings.

During June, I had called IIO ( VSC) to check status and she informed me that I am close to decision and asked to check after two weeks. Later a month ( on 15 July) ILO said mine is very close as they are processing Aug 15 cases.

My I-140 was approved for CP and I did'nt know anything about calling NV centre or my attorney never gave me any info regarding that. I do not know what is really happening in VSC and anybody in this situation as myself. If so please post messages .

Did you get EAD/AP on time

because even if the I-140 was approved for CP, when you file I-485, the case is then transferred to INS. Also, you wont get EAD/AP for a CP case. Also, nothing special is required for converting from CP to I-485. Thus, if you have had the ead/ap, then the only problem, i guess, would have been that your case wasn't taken up and not the CP to I-485 one.
 
I have my EAD and AP which was issued a sometime november 01. When I checked with IIO , they said everything OK and they will take a decision soon and two months passed since then.

I am not seeing much Aug approvals in this forum and wondering why people do not post messages. Is this due to all Aug cases are over or not many approvals?
 
Check with NVC

Mine was also approved for CP (VSC's mistake). The approved I-140 petition was sent to NVC. NVC sent me a letter offering me the option to do AOS. I had to respond in 30 days telling them my intention to apply for adjust of status here. Now, my file is noted that I am applying AOS and the file is on hold at NVC until INS requests it back.

If you don't respond in 30 days NVC will send your file to your country's consular for CP. You can check with NVC (with your INS EAC-number or the NVC case number assigned to you). You should hear something like "on xxxxx date you wrote to us indicating your attention for adjustment of status in the USA. Your file has been noted … ").

Since you did not hear anything from your country's consular, your file should have been on hold at NVC. Or if your I-485 (AOS) is being processed, the file might have been transferred back to INS at VSC. The file transfer (between NVC and INS) can take quite a few weeks.
 
Would there be any delays or problem?

My I140 was approved for CP from TSC even though I never opted for it. I brought this to my lawyer's assistant and she said that it's normal as INS does this some time and asked me to file my I485 as usual.I never had any correspondence with NVC .
I have file i485 on JULY 12 2002. Do you gys see any problem?

My I140 was approved for CP too, but I filed I485 according to lawyer's suggestion without contacting NVC. Still wating for approval.
