I have finally received my green card !!! I want to thank everyone who wrote to this forum for the invaluable information and I wish luck and speedy processing to everyone!!! My own experience may prove useful for somebody, so tried to summarize it in the attached file.

Request to expedite FBI Name Check

Thank you for sharing your experience and congratulation with I-485 approval! I have some questions regarding request from a government entity to expedite processing. My situation is similar. I am stuck with the security checks (most probably due to FBI name check). Although formally I am affiliated through University, in fact I work in Government Lab. In particular, I am a PI in some government projects. So, I am going to ask my government sponsor to write a letter to expedite processing of my I-485/name check.
1) I heard that one government entity (e.g. lab) cannot ask another government entity (FBI, USCIS) to help solving a problem. Did you have any problem with your government sponsor / supervisor in this context?
2) Did you ask your supervisor to write a letter to expedite processing of I-485 directly to USCIS (http://uscis.gov/graphics/fieldoffices/expedited.htm)? Why?
3) What your supervisor position is (Lab director, department head etc)?
4) My case is rather ‘fresh’ (see signature). My application I-485 was out of processing date during only one month, but NSC Current processing date for I-485 recently jumped back from May 1, 2005 to April 29, 2004. May ask to expedite processing in this situation or should I wait when my I-485 will be out of processing date again? I am from non-retrogressed country.

I don't know what would happen if you go to the upper management. They potentially can come up with all sorts of reasons for not doing anything. Don't go too high. I just asked our department leader, he wrote a letter from himself and it worked!

I did and he wrote to USCIS directly as well. They never responded to him, while FBI responded right away.

Are you sure you are stuck because of the name check?
Call TSC and ask them. If this is the case, FBI does not seem to care about USCIS dates, so you can write to them even if you case is before processing date. At least my supervisor did not mention that my case was overdue in USCI, just stated how long my name check was pending.

For Cong/Senator use www.house.gov and enter ur zip code.



for agency read the following and do confirm using their web site about current director and division. ignore the room numbers.

Thank you very much for sharing your experience.
I am in a similar situation..struck in security check..and retro. I am not sure if I should try to expedite security clearance now..my attorney is telling me that the name-check is valid for little more than a year and everything needs to be done again..if my petition is not approved within that time period!
Good luck to everyone who are struck with FBI clearance..Hope the new year will bring us some good news!

USCIS just told me a week ago that my file is in pending and check process. I was reading your experience and very much impressed that you have shared alot. Could you please tell me that how to get this FOIPA request form? and should I apply earlier because people are waiting to get their results for ages. any advise for me would be very helpfull. My I485-I140 is not aprove yet and now after my intewie and my PD updated they are telling me this check process. My marriage is also in pending because of it :eek: .

Thank you for the wealth of information. I am still not clear as to how to expediate FBI Name Check for I-485. My fingerprints have already cleared. I call them or write them or someone does that on my behalf?

How to check , fingerprinting has been cleared.We have done our FP code 3 on 04/08/2006 but no LUD change so far.

If you know that you are struck in Name check, you can request your senator or congressman for help. It depends on your representative..sometimes they just do a status enquiry..if they take some interest then it is possible to expedite I guess.

Generally, FP will get cleared within 24 hr. There is a phone number that you can call..to check the FP status..remember that number is only for FP and not for Name check or security clearance!! You can get that number in one of the name check threads in this forum.
