I-485 approval after WOM

I want to thank this forum for the help and support. Today I recieved the long-waiting email from CIS.

The following is my case time line:
I-140 (EB2, NIW-China), RD april/04, AD Mar/05
I-485 RD April/05
1st FP Sept,05
NC probably started and pending since July 05
contacted FBI through email, no answer
contacted congressman, NC still pending
Filed WOM pro se, Nov 22, 06
2nd FP, Jan 06, 07
Card ordered Jan 22, 07 :)

Congratulations!

Did you file WOM yourself or by attorney? My i-485 is stuck in name check since June 2004. My PD is Aug. 2001. EB2, China. I don't know if it is too late to file WOM. Thanks for your help!

Sorry that I don't have those files. I just copied these citations from other sample complaints. I guess you can find them from PACER system, but I didn't do that.

Is this letter all you had to file (along with the exhibits)? Or were there some other forms etc that were also required?

Yes, basically this is the only letter I filed (with exhibits of course). All I did is to fill out the civil cover sheet form, together with the summon form, and file them to the court. Of course it is not mandatory for you to prepare the summon by yourself. However, it will save you the time waiting for the court to return it to you.

I went to the court to file the complaint. After filing, I got a sealed summon form and a copy of complaint stamped with case # by the court. The court took two other copies complaint. In addition, the court gave me some orders of its local rules.

I copied the summon form, stamped complaint and court orders. My husband mailed a copy of these materials via certified mail with return receipt to each defendant, plus the US Attorney General in D.C., and the US Attorney's Office of Northern District of California. I could not do the mailing by myself because of the civil rules. The last one is the most important to serve. And for this one, you have to put "Civil Process Clerk" as the receipient instead of the Attorney's name according to the Federal Civil Rules.

After receiving the return receipts from USPS (it will take a long time for some Defendant to return it, and some you may never receive it. Please go to USPS website asking for e-mail notification and print out the notice then.), my husband filled out the certificate of service form, and filed them to the court.

And wait patiently. You will get your GC soon. :-)

So some one, other than the defendant needs to MAIL these complaints to the defendants? That's a weird rule.

You said that the last one (the one to the US attorney's office in Northern California) is the most important one to serve. Why is that? And was it in reference to this one that you mentioned its required to put "Civil Process clerk" as recepient name?

Do we HAVE to use USPS or Fedex/UPS are fine too? BTW, what is the "certificate of service" form and why did your husband have to file it (as opposed to you)?

Yes, this is by Federal Civil Rules. Read it carefully.

Your understanding is correct. I was referring to the US attorney's office in NC when I talked about "Civil Process Clerk". Again, please read Federal Civil Rules carefully as this is documented there clearly. This is the most important one because he/she will push USCIS to take care of your case, not the one in D.C..

Federal Civil Rule says USPS.

This is the second page of summon form. My husband is the server, so he filed it.
