Hello Ciba

have applied I-485 for myself in 2000 , got married later after I-485 application. Attorney says it is not a problem
applying my wife\'sI-485 application as long as my I-485 has not been approved. I just needed to check up with
others on this site.

Hi alcapone,

Your lawyer is right. If your marriage came after your I-485
approval, your spouse would have to wait outside of US for years
to be able to immigrate. That is why many people get married
before filing their AOS, because the wait will be considerably
shorter.

Hello Ciba,

In this case, is it an acceptable practice to withdraw your
I485, then get married and get your spouse to US, then refile
with your spouse added to your application?

How much time does it take to get GC for wife if she is here
on, say student or tourist visa, AND you already have your GC?

Spouse of a green card holder has to wait for the cutoff date to
be current before she (he) can immigrate (concept is similar to
EB priority date). Usually it will be several years due to the
backlog.

Fortunately, there is a new K (or V?) visa which will allow GC
spouses to come to US to wait for status adjustment. I am not
very familar with the details.

Before the new visa becomes available, it\'s better to bring spouse
in on H4 status (student visa is probably OK, but tourist visa
is not). The spouse still needs to maintain status throughout
the stay until AOS is filed.
