I-485 & AP - Need help!

My Wife's H4 is expiring on Jan 30 2003.
Our I-485 and H1 extension is pending and we haven't applied for AP.

Can she leave the country and come back on Jan 26th before her H4 expires? Would there be any problems at the airport while entering as her H4 is valid for just 4 more days? Or should she apply for AP and wait till she gets it before her travel?

Any info on this would be greatly appreciated.

Note: Aliens holding valid H-1 (temporary worker in a specialty occupation) or L-1 (intra-company transferee) visas and their dependants who have filed for adjustment of status do not have to file for Advance Parole as long as they maintain their nonimmigrant status.

Some people advised me to apply for AP anyway just to be on the safe side.

Does anyone has experience of applying AP by themselves without going through a Lawyer? Just feel it may be cheaper/faster that way. How long it takes now to get approval? Used to be 1-2 months...

I've applied AP for my spouse and kid on my own on May 02. By Jun 14th I got the approval for my kid. My spouse's was also approved as per the status, but I never received the notice yet. Otherwise, you can apply on your own and you will get it approved. It will cost only the application fee for you. Lawers charge anywhere between $100-200 just to forward your application. Again getting an approval is purely based on your luck and not based on whether you apply thru a lawer or not. For the cost of applying thru a lawer you can apply yourself for three times and out of three trials you will get approval at least in one of the trials. So best of luck. It is a gambling, like buying a lotto or playing in a slot machine. If you get it in the first try you must be the luckiest. Keep applying.
