I-485 AOS with K-3 Visa

What to after K3 approval??

I am in your situation as well, and was wondering if you would be willing to share the steps you have taken after your husband came to USA.

I have completed the K3 for my wife and she will be coming to USA in the last week of this month. From what i understand i will need to apply for her I-485 and I-765 (EAD) upon her arrival!!!!!

Any feedback will be appreciated.

When someone come on K-3 in USA, does it mean that his/her I-130 is already approved or they they come after I-129 approval. Can you apply for AOS I-485 even if I-130 is not approved. How long 1-130 and I-485 are taking this time for approval.

When a person gets a K3 visa ( I-129 approval) they can come to US on a non-immigrant visa which also entitle them for a work permit. It does not mean that their I-130 is approved, however it gives them a way to move to US while their I-130 is being processed.

From what I have read on this and some other sites.. Upon the K3 holder's arrival in USA he/she can file for I-485, even though the I-130 is still not approved. :cool: :eek:

Yes i agree with jannoo,as iam also in the same boat.I came on k-3, and i obtained my SSN and EAD also FILED I-485 AOS While my I-130 is in process.
