I 485 AOS interview for MA widow

I live in MA and I have my interview on 31st of July 2009 in Boston. I am a widow, my husband having passed away in June of 2008. I have not found any documented experiences for AOS interviews for widows who were married less than 2 years. Note that J Napolitanos memo of June 15 th (ssad.org/images/Surviving_Spouses_Deferred_Action_Guidance.pdf) and the first circuit Supremes’ court ruling (ssad.org/litigation/tainglitigation.html) on the widow penalty has changed the way such cases are handled. I have an approved I 130 .

Your I-485 will be denied I am afraid. I-360 does not apply to you either, if the length of the marriage was under 2 years at the time of the US citizen's death. I would advise consulting with a competent immigration attorney.

I have an approved I 130 .
