I-485 and travel

Hello All,

I had my I-485 interview way back in April, but the green card is stuck in the name check process. The I-485 is through marriage to a US citizen.

I wish to travel outside the country. Does anyone know how I should apply for permission? Is is I-131?

If you where an overstay of a previous visa, consider waiting till you get your greencard in hand before traveling. Advance Parole could be granted to you, but the POE officers aren't obliged to honor the AP. So, you could have a legitimate AP, but denied entry and deported back to your home country, even with a pending I-485. So, unless it is a life threatnening emergency or death, settle down and wait till you have your plastic greencard in hand or risk being barred from the US for some time.

If you were not an overstay, then AP will be the only available document whic you need to use to travel. However, since name check seems to be a complex process, your energies should be devoted to harassing FBI or your Congressman or USCIS to ensure that your name check is done.
