Hi All,

I use this forum and found very useful.

I have applied I-140/I-485 concurrently(NIW) in March 2004. I had applied I-140 immigration petition under EA category. My I-140 (EA) has been approved. I requested writing a letter to USCIS, VSC to interfile my pending I-485 application (NIW) case to approved I-140.

I dont know how USCIS will process my case. Is there any chance to receive a notice from USCIS? If so how many days I should wait to receive the notice.

Anybody has gone through this interfile process and finally got I-485 approved.

Please put your input here. I appreciated your response.

Thanks

did you sent the letter with certified return reciept mail?

---- I dont think they will send you reciept notice of Interfiling

--- I have read 3-4 caes in pat 2 years. recently I read a case where person was on H1 and his LC, I-140 was filed by employer A and he filed I-485 and he left employer A and joined employer B on H1 then as back up plan filed LC through B and I-140 through B, his LC and I-140 got approved for B. He thaught his employer A has revoked his I-140 but he was surprised to know that his I-485 filed based on emplouer A got transfred to Local USCIS before he could request USCIS to approve his I-485 based on new I-140 of B. He took help of NYC lawyer Cyrus Mehta and lawyer and prepared letter to interfile newI-140 at the time of interview and lawyer went with him to attend interview but the officer never asked newI-140 and asked about new employer job offer letter. as i understand it seems the past employer may have tried to revoke I-140 after I-485 pending more than 180 days but USCIS approved the case as AC21 ( I think the USCIS can check with his A# that new I-140 is also approved for him) it simply means the interview officer took the shortest and simple route to approve the I-485.
