I-485 and higher salary

Hi all,

I just got my I-140 approved and I'm moving to this forum.
I have one question, my salary right now is 30% higher than the labor certification salary. I'm in the same sponsoring company. Will this be a problem at all? My boss can work it out so my salary is closer lo LC salary and I get a bonus. Should we go though this trouble?

No need as long as job profile is the same or 'similar'.

I don't want to be the voice of doom here, but 30% might be significant. It might not. USCIS looks at all combinations of salary, duties and job title to determine if the job is similar.

How long has passed since the LC? Has your job title changed? Have your duties changed? This is an area where common sense seems to predominate at USCIS, but I will say that if the salary has gone up 30% in a short period of time, USCIS may inquire about the duties and title. If they are similar and significant time has passed since the LC, you will be fine.
