I-485 after F-1 expiry, complications
Hi, I have been lurking in this forum now for several months to get information. Now I have some specific questions. First I need to tell my story though. I will post the story as a timeline:
12/15/2010 - My last day of classes at university.
01/09/2011 - Got married to a USC, and moved cities to live with her. Made sure to change sevis address using university website.
02/03/2011 - My F-1 status expired because I did not register for spring classes.
04/28/2011 - USCIS received my I-130, I-485, I-693, I-864, I-765.
05/31/2011 - Had biometrics taken.
07/10/2011 - Received EAD in the mail.
07/12/2011 - Had interview, at the end of which I was told I would get green card within 4 weeks.
07/13/2011 (today) - Got a visit at home from an ICE senior special agent. He said that he would have arrested me on the spot but he had checked and seen that I had an I-485 application pending, so if it was approved then a judge would have thrown case out of court, wasting time and money. He also said that I should contact USCIS and get proof for him within 2 days that my I-485 was approved. I checked online at the same moment what status was for my I-485 and it said that it was in the document production phase. I gave him a print-out of that, and I also gave him a copy of my EAD. He left, saying that I should call him in 2 days to check if the case had been dismissed.
Now the questions.
1. I thought that after I applied for AOS, I was safe from ICE?
2. I received no letter in the mail before ICE showing up my door. Is this normal?
3. Am I safe from ICE at this point, given that I-485 is approved, although I don't have GC yet?
4. In the future if I have to fill any forms indicating if I have ever been under deportation proceedings, do I have to answer yes?
Update: I just received a call to fax the agent a copy of marriage certificate and then he can get case closed. That gets rid of question 3. I'll go and send the fax now.
