Dear friends...

I need help to file I-290B forms for my wife and daughter. I assume each form for each of them.

Questions:
What should i write in "In the matter of" box? Is it my name or the person i'm petitioning?

In the "File number A -" which means the Alien #. Is it mine? or theirs? What if they don't have A# yet?

Thank you so much for your help. Really appreciate it.

It was I730. I tried to petition my wife & daughter. Denied was because i didn't submit enough supporting documents such as sworn affidafits & pictures of marriage. Eventhough i had submitted my australian marriage cert. My wife has done her fingerprint taken. I believe she has got her A#. But not for my daughter.
Denied by the Nebraska officer. Do u think i still have my chances if i resubmit those required docs?
Thank you so much

First, did you get granted asylum or did you enter as a refugee?

From what country did you seek asylum/refuge?

IF you got married in Australia, did you marry before or after getting asylum/refugee status?

IF you resided in Australia before seeking asylum in the U.S., how did you overcome the "firm resettlement" issue?

Did you include the spouse and child in your original application for asylum or during refugee processing? IF yes, things may go OK, if not they either don't qualify for the I-1730 or you will be accused of fraud.

An I-730 may be filed within two years of entry as a fugee or grant of asylum but only for pre-existing spouse and children. Each one requires their own individual petition.

IF your grant of asylum or entry as a refugee is more than two years before filing, then you have to adjust to LPR and file an I-130 instead, after naturalizing individual petitions are required.

Is the child you biological, step or adopted child? It makes a difference.

To BigJoe5,

Yes i was granted asylum on June 2010.
I came from Indonesia where i seeked for asylum.
I entered US on 2006 and we got married in Australia way long before on 2000. That time we were students in Australia.
And yes i included my wife & daughter on my initial asylum application on 2006.
I did filed each I-730 for each of them, 2 months after i was granted. After i had my new I94.
And yes!, my daughter is my biological daughter.

I came as a tourist. We got our visas together but i came in to US first. Then i got granted, i filed I-730 when thry were still in Indonesia. 2 months later we decided my wife & daughter to enter US with their valid US tourist visa. Then i resubmitted and informed USCIS that my petition beneficiaries are already in US. We did because my daughter got sick as missing me so much. As i miss them so much.. terribly so much.;(. But this wasnt the problem as i have my court transcript when judged interviewed me why didnt they come along since they have visas. Bottomline is.. the officer whom handled the I-730s doubted my marriage certificate.

Thank you so much for your attention bigjoe5, really appreciate it.
