Hi Gurus,
My wife came on F1 to USA in December 2007 and had to leave due to family issues in May 2008 to Australia (her passport is Indian). Now she wants to come back to USA. My Asylum got approved in March 2010 and her application is pending for derivative status. What is the best way to get her to USA ASAP.
Her F1 is valid till Jan 2011.
Jay.

She cannot enter on F1 unless she intends to attend school and gets a new I-20. Since the fall semester has begun most places, she is unlikely to be able to return before Jan 2010 anyway.

Unless she wants to jeopardize her petition that is pending, she should follow all immigration rules and regulations regarding legal entry. This likely means that it will not be possible for her to enter ASAP.

Concerned, your concerns are fine, and i honor them.
But the only difference is, for me, the greatest & most passionate achievements in life involve the most risk and that is the only way to live life completely.

Why can't she claim asylum at the port entry? She has a genuine approved asylum case! How does she jeapardize her petition, can't she settle it later with infopass? I am aware of schools who can still give me an I20 pronto, I am just trying to save 400$ dollars for a new SEVIS registration and bank statements which i will have to show the university. grrrrrrrr...

I will still want you to shed some light of jeapordizing an Asylee case, don't u think that asylee case itself is questionable? I believe than approved case has more chances of overcoming most of the illegal or legal issues.

I would still want to read your views!
Thanks Concerned.

I'll take back my comments, seems like you don't know much about asylees. I just observed that i posted this in the wrong section.
