I-1485 blocked due to company name change

I just spoke with an IIO at VSC, and he said that my I-485 approval is blocked due to a company name change (merger) between the I-129 and I-140/I-485, and they didn\'t have a way to link the two together (although the I-140 is in the acquiring company\'s name). They will wait for the AC21 regulations to approve this case. Is there a way I can have this resolved by filing some paperwork. Will appreciate any help.

vscbound,

One possible way is to file amended I140 for successor-in-interest. See previous postings on this forum by several IGATE company people.

If I understand your post correctly, your company name changed between Labor (I-129) and I-140. This should be a non issue since your I-140 already has the correct name. If INS had any problem it should have been cleared at I-140 stage itself. Get congressional help if this is the case since your case cannot be held up for this issue.

But in case the name change happened after you filed I-140 you might need to file amended I-140.

My 140 was filed after the merger, and it\'s already in the new company\'s name. This is really irrational on part of VSC. They somehow cannot link I-129 with I-140, although they approved the I-140 in the successor\'s name!!!! Is there any way to file documentation proving that the successor assumed all responsibility, etc. proactively?
