Hi everybody.

My H-1B sixth year anniversary is Aug 2007. My company (a school district) is about to sponsor my for LC. My attorney is just started getting the info from them and will go from there (doing all the advertising, filing for LC, etc).

From what I understood, I will be able to extend my H-1B beyond the 6 year limitation IF I get my I-140 approval before my H-1B expire in Aug 2007.
What is the likelyhood I will get my approval before the date (at TSC).

Should I even pursue this? I'm afraid that after I paid several thousands $$ and the chance of me getting the extension is none.

Please give me some input.
 
You have 1 year before your H1-B expires. That should be enough time for you to get your LC and I-140 approved.

Your Labor will be processed by PERM which means it should get approved within 3 months. I-140 may take about 3-6 months. So all in all you have sufficient time.

However note that it all depends upon many factors such as proper procedure followed by your attorney, getting your LC and I-140 without any 'major' RFE etc.

And the good part is that when you get your I-140 approved, you'll get an H1-B extension of 3 years and not 1 year.

Is 6 months unusual??

Hi everyone,

My wife and I filed concurrently at TSC with RD January 26, 2006.

So far, our i-140 has not be adjudicated (multiple LUDs ending 3/29/06).

So it has been almost 6 months since we filed concurrently without any news on the i-140. Is this unusual? Is this something to be concerned over? :( Please please let me know.

Here are our details:

TSC, EB2, Concurrent filing, worldwide (RD: Jan. 26, 2006)

My petitions:
FP (walk-in Feb. 11, 2006)
i-140 (Pending - LUDs ending on Mar. 29, 2006)
i-131 (AD: June 28, 2006 after a senator inquiry)
i-765 (Pending - LUDs ending on Mar. 29, 2006 - TSC's responese to inquiry is "additional review is required, which is causing the delay in processing time")
i-485 (Pending - LUDs ending on Mar. 29, 2006)

Spouse petitions:
FP (walk-in Feb. 11, 2006)
i-131 (AD: May 9, 2006)
i-765 (AD: May 9, 2006)
i-485 (Pending - LUDs ending on Mar. 29, 2006)

i files only I140 directly to TSC with receipt date Feb 27th and nothing so far.

all will be well and even if it takes a little more time in worse case scenario to complete two stages,u can go for year by year extension if ur labor is approved.
 
Hi gcahiever. Thanks for your word of encouragement.
However, I didn't know that I can apply for year to year extension once my LC is approved. I thought that It has to be had pending for over 365 to qualify for the yearly ext.

I'm just so exhausted dealing with everything. I've been dealing with this for almost ten years, It started through Asylum. A few members of my family received the approval and now have gotten their GC. On the other hand, my asylum case was appealed three times, and were all denied (that's why I moved to H-1B). The funny thing is that one of the person who applied for this asylum was my sister, so all the scenarios were the same, she got her approval the first time. I've also asked to stepped out to Mexico, and stepped back in. I've spent a FORTUNE to pursue this dream.
This is why everything that y'all repond help my decision.
