Is is true that the employer can revoke an approved I-140?

I am confused because I thought I-140 is something the employee submits and once approved he/she owns it and employer cannot revoke it.

Please advice.

Eagerly waiting for reply.

pls shed some light

I am confused. Isnt I-140, which is the immigrant visa held by the employee/individual once the application is approved.

How can a employer revoke this after 140 is approved.

Please advice.

I-140 is filed by the employer showing their ability to pay wages etc. The employer has all the right to revoke an I-140 at any point of time. If they revoke an I-140 after 180 days of filing the I-485 it doesnot have any effect.

If you have an I-140 approved earlier in your name and even if the employer revokes the I-140.. you can use the prioririty date with your new employer. There has been lot of debate and confusion regarding this topic.

So double check with your attorney on this.

Ahem ????

Question: I am planning to go to Canada to pursue a Masters degree. I am not a Canadian Resident.

Can I apply for Consular processing in Canada once my 140 is approved?

Thanks much.
