I-140 With Substitution Labor

Hi All,

I'm new to this forum. I'm getting an offer to file for I-140/485
with the substitution labor from XYZ Company, while I'm working with Company ABC.

My Questions are :

1. I just want to know what is risk factor while applying for I-140.

2. What are the chances of approval/Rejection of I-140.

3. What main Criteria ( Degree, Experience Etc..) we must look on
to apply for the I- 140/485.

4. And If anybody has any Idea what is % of Approval/Rejection
in the cases like this.

Would appreciate your help.

make sure the following :

- they have the original LC

- education and experience match your atleast 70%
ask for copy and get validated with your attorney.

- make sure the company can justify the ability to pay
ask for proof and validate with your attorney.

- make sure not to lose control until 140 approved and I1485 application passed 180 days.

But here again I've some questions corresponding to your response.

Your response : Make sure they have the original LC.
Question : As I never seen any approved LC, So How can I make sure that they have the Original one and not used this any time
in the past or this is not the photostate copy.
And Again this LC, thye got in Feb'2001 and applied in 98.
Can I use this LC now..?

Can you give an Idea how to test that LC is original.

the only way is that when I will file for my I-140, then only I can see the past two-three years tax returns..

Question: I'm planning to file only for I-140 at this time and they
are saying that the papers corresponding to filing of I-140 and
all the correspondence will be going to at their office for I-140 and
when I will file for I485 then all the addresses will be yours..

another clarification

for a labor subsitution your qualifications have to match the original labbor approval...

Is it absolutely must that the qualification must match as of the date the original LC was filed -

My current qualification match the approved labor but they did not match the condition on the labor when it was file about 4 years ago...
