I-140 Wages per week (is it current wage or mentioned in labor )

Hi,

I had my labor prepared by a lawyer who no longer practices immigration and moved to corpoate litigation stuff, but luckily it got certified after 4 years. Now my company found a paralegal in his office. She says she can file I-140. I just want to understand that mistakes don't happen even if she files, as it's time consuming nowadays.

Form I-140.

I have a question In Part 6 (9) about wages per week. Will it be wages I had in orginal labor application (year 2002) or current prevailing wages or my current wages?

Also, Part 6 (8), Should a new position be check marked? It was a new position when I joined the company but it's old now.

Appreciate your help.

I believe the answers are
-6(9) the wage per week must be the wage OFFERED by the employer from the Labor; pls note this is not necessarily equal to the prevailing wage
-6(8) yes, this a new position.

Can a paralegal check any item from earlier labor filing or any supporting doc, to make sure it was marked as a new position in a labor?

Coincidence

I will be filing my self and Infact, had the same questions. Just got off the phone with one of my friend whose I-140 was filed by an attroney and approved.

I was told answer to part 6(8) this a new position - the answer is "NO"

The salary is the salary mentioned in the LC (ETA 750)

I don't know what old lawer filed or told labor dept?

Do I-140 processing people know from labor or from any supporting doc filed with labor or from my H1 visa or from employer tax return?

Does employer tax return have info about new employee hired in a year?

Any help will be appreciated.

I think....

It is an old position because, while filing the LC, your resume tells that you are already working in that position. Doesn't it?

I-140 approved

My I-140 was approved in two days in PP. I was worried about RFE especially small company size and financials. But luckily, my employer worked with a company my friend told me to go for preparing I-140.
True to friends' word, the cover letter was perfect and all required information provided, all necessary document attached and organized which must have contributed in aprroval quickly without RFE. In fact my employers fax machine was not working for two days and I was worried about delays but when I checked online, it was approved. Preparing for RFE is a time consuming and this board has many posts with denials, best way is to avoid it.

I am filing my I-140 myself and will be mailing next week. So, can you confirm what answers you have provided in your applications for
Part 6 (9) about wages per week
and Part 6 (8), new position?

You were right. My application had a wages from Labor and old position box was checked.
