I-140 transfered from California SC to Texas

Hi ,

I'm reding this forum often but never post, so I'm doing it now. My I-140 form was filed November 22/2005 in California Service Center two weeks ago 03/22/06 my case was transfered to Texas Service Center.Two days ago I got that message from them /see enclosed/ an RFE notice.I haven't got the notice but I guess is related with abilty to pay and shit like that as I see in this forum.So one more time we eat shit and I was thinking that atleast I have to wait for EB# visa number , but it appears that I have to struggle with that form two.Shame on the American government!!!!!They have the means to help the restrogretion but don't care! I'm start thinking of leaving everything and go back to my home country.It's already 4 years of NOTHING!!!!!
Hope that give's you an idea which cases are subject to review now.

Do your Company Have Ability to Pay problem ?

What did your lawyer submit to CSC ?
1) Financial Document from Company.
2) How many years of W2
3) Paysub ?
4) Is your company have more than 1000 employee ?
5) Did you send letter from a Financial Officer ?

I think if you need advise, you need to give more detail about your case.

Also are you under Eb2/3 ?

Are you EB3? We haven't seen any movement at all on EB2 yet.
Its really sad but true that we have to go through all this and then they talk about legalizing illegal immigrants.. Anyways, understand your pain but hang in there buddy... There's always light at the end of a dark tunnel..

Substitution?

Hernesto, we all share your pain - just buckle up. Things will change soon.

Was the I-140 applied based on your own LC approval? If yes, then definitely there are missing documentation and/or not updated latest financial sheets from your company. Your lawyer will be able to take care of this and solve it.

If you had a substituion I-140 filing, then it might be an equivalency in credentials and background RFE. This can also usually be easily explained. I have seen many RFE's coming on substitution and they have cleared after replies.

Take it easy year - there are lots of people in the same position and US will lose a lot of skilled workforce if they don't pass legislation to clean up this soon.

Thank you guys for replaying.

I'm EB3 - skilled worker. As KHCHAN said and I hope is that. Since we filled the petition in November last year I guess they need the taxes of the company for 2005.The company is 15 people so is not big.I prepared all the documents they need as my lawyer adviced when we filled, but you know there is always something new ))))))) I remember when I was dealing with my Labor Certification - yes, is personal I mean is for me is not substitution or something - so I got notice requesting the documents I already sent ))))) - Diploma, Experience letters, letter from the company on company letterhead .......so the point is that I think they don't even read or check is just o.k this is approved and this 3 no, let ask them for new documents ))))) that's the shit that bugs me.I know that even passing the second obstacle I-140 you have to wait for the visa number available but at least you passed the secon one and is history.
We'll see guys as soon as I get the notice I'll post what they want.

Not trying to be a pessimist, but i just hope this blanket approvals from TSC for lot of CSC cases is not a system error. I will want to wait till i receive the notice to believe it. yes mine got approved in less than couple of weeks after the transfer to TSC.

what is your category EB2 or EB3.
 
I find this Memo for processing I485 even no visa number is available.

I hope is something real, that will help.
Otherwise I'm collecting all the documents that they requested from me. Taxes 2005, Quarterly reports 2003,2004, forms W3 for paid taxes, articles of incorporation of our company, yellow pages copi of directory other evidence of business - adds, newspapers etc. and 2 letters for work experience.
May is comming friends I hope I'll get lucky on the lottery /11 years/ and say f**k to everything and go doing the fast consulare prosidings.

Adjudication of Employment Based Applications for Adjustment

In conjunction with Backlog Elimination efforts, on April 12, 2006, the Nebraska Service Center (NSC) will begin to process Employment-Based I-485 (EB485) cases for which visas are not currently available. These retrogressed EB485 cases will be processed in a normal fashion with officers reviewing applications for eligibility and processing the cases to the fullest extent possible up to the visa request stage. Officers may be required to issue a request for evidence (RFE) for some cases. Applicants will be expected to respond to the requests for evidence in a timely, accurate and complete fashion (as they normally do) to continue the processing of the case. Applicants that do not meet eligibility criteria, or do not respond to a request for evidence may be subject to a denial of their case. Applicants that meet eligibility criteria will have their cases forwarded to a visa staging area where the cases will be checked monthly for visa availability.

The intention of this "preadjudication" initiative is to prepare eligible cases to the greatest extent possible, short of approval, in anticipation of the availability of a visa. Security checks for these cases will be electronically maintained so it is imperative that applicants respond to both requests for evidence and/or fingerprinting appointments in a timely manner. When an eligible case is identified as having a visa available, the case will then progress through a final phase review and formal visa request to facilitate the final disposition. Please do not conduct inquiries on EB485 cases for which visas have recently become available (within the last 90 days).
 
This preadjudication is for already filed 485 applicants before retrogession set in. Its not like you can file for 485 even if your PD is not current
