I-140 Success Story

I Just wanted to share my story here hoping that it would help anyone looking to navigate the immigration journey in the future.

Field of Study: Pure Mathematics
Highest Degree Awarded: PhD in Mathematics, 2023 (from a US institution)
Current Employment: Working as a non-tenure faculty at a state university in the US
Immigration Law Firm: xxxxxxxx
Petition Type: NIW EB2
I-140 filed date: 09/25/2024 Approval: 01/23/2025



I started the NIW process with xxxxxxx almost a year ago. Due to delays on my end, I could not submit the petition in a timely manner, so it took me around 6 months to finally finish everything off. Anyway, I am so glad I was able to file a successful I-140 petition (under EB2 NIW) with xxxxxxx. I had 3 published research papers with about 15 citations by the time I filed my petition. I also incorporated 4 recommendation letters to strengthen my petition letter (one from my PhD advisor and 3 independent researchers). My I-140 finally got approved in about 4 months with no RFE, which really was surprising given the current processing backlog.

My educational background is theoretical (pure mathematics), so I was not quite sure how to build a strong case initially. In particular, it was a challenging task for me to write a Statement of Contribution in a way that it is accessible to non-specialists. However, the xxxx assigned to my case was very helpful in navigating the entire process. I was provided with feedback & answers to many of my questions/concerns promptly throughout the process. Overall, I am truly impressed with how smooth the entire process went with the xxxxx. It was a pleasure working with them, and I would like to recommend the xxxxxx to anyone looking to begin their immigration journey.

This is a "NIW and EB1" forum and your I-140 got approved in EB2 category (in spite of having a Ph.D.) - why not EB1? Just curious...
 
Self-petitioned EB-1 (A) has tougher requirements than self-petitioned EB-2 NIW. When I began the process, I had a Ph.D. and a single-authored book with a reputable publisher. Still, the law firm that handled my case advised to go via the NIW route. Back then, unless you were from India or China, there was no wait time for EB-2 applicants. You get the same green card, so it's better to choose a path with less resistance (where you're also not tied to an employer).
