I-140 Stuck

Hello Everyone,

I filed for I-140 and I-485 concurrently in August 2007. I-140 Receipt date is August 6, 2007
I-140 Notice Date is September 27, 2007.
LUD on I-140 is 09/28/2007.
Texas Service Center

EAD and AP approved for both myself and spouse.

My 7th year H1b expires on 27th August 2008.

There has been no update on I-140 at all since then.

Anybody else in same boat? I would really appreciate your input. Even if your I-140 has been approved, please, still let us know.

Another Question - Can I apply for 8th year H1b now as I don't know when I-140 will be approved? If yes, on what basis?

Hi. I would think your I-140 approval should be near. I applied concurrently on 8/14/2007 with a Notice date of 10/12/2007. My I-140 got approved 2 weeks back, the same day the current I-140 processing dates moved to 8/26/2007. There was a soft update sometime in November, other than that there was no activity. The approval email will just come in when you least expect it :).

You should be able to apply for your yearly H1-B extension based on 'past maximum stay (6th year)' extensions since your I-485 is pending. Others might give you more accurate information on what it is actually based off of or consult with your attorney. The company I work for applied for my 9th year H1-B extension which was approved a few weeks back.

Hi Jawad,

Good to hear about your case. I applied my 140 & 485 together on 7/26, EAD approved on 9/24, still my 140 is pending with TSC. I don't know how long it will take for my 140 to get approved.

Hoping for the best.

I-140 ?

Hello - I had applied for i-140 and i-485 concurrently in July 2007. I got date received as 24th Sept 2007 and I got EAD approved and had my biometrics done back in October 2007 itself. Is there a way to tell if they are processing the records for September 2007 now that the last update showed it was processing August 2007 at Texas center. I have been fortunate that my old employer is ready to process the GC even though I dont work with him anymore. But right now I am really worried on how long its going to take before I hear anything. My case is not H1 to GC jump but I got my GC app in the queue when I was on student visa. Anyone ever face any of these conditions before ?

Also has anyone ever travelled when their app was pending ??

I checked trackkit.com and noticed there have been very few EB3 I-140 approvals in the last few days. I wonder whats keeping them? What a mess!
