I-140 Salary Question

I got my PERM labor approved a few days back and now applying for I-140. When we applied for labor certificate we mentioned my salary higher than what I am being currently paid. Now my question is that with I-140 we have to submit pay stub and w-2. Will this create a problem?

I talked to my lawyer but she says that pay that is mentioned while applying for labor is the one that I should be getting when I get my GC. Is it true?

Make sure that you getting paid equal or more than the salary mentioned in your LC since LC filed date (Priority Date). And send the latest paystub when you are applying I-140.

With the benifits that are in the pay stub I very easily cross the amount mentioned in LC.. does benifits count towards the amount in LC. Please help
Thanks

There is a very good ability to pay thread spanning over 100 pages. Look for that thread in these forums. You are likely to find someone with a similar situation as yours in that thread.

In my opinion benefits do not count. If your salary is lesser than shown on LC then your company will have to show enough profit, cash in bank to prove they could have paid the difference in amount from the day your LC was filed.

I-140 salary problem

When I submited my LC on 07/14/2003(my PD), my salary was a little lower than LC required, but on the following month (1st of Aug. 2003) my salary was increased and higher than LC required. My company usually increase salary at end of July. Does somebody know if this will has some trouble for my I-140 approval. Thanks!
