Sorry guys for taking long but I could not post and I didn't know what to do. I got a rfe they want letters of more exprience and my company detailed tax returns for 2001 though we gave them 1999& 2000 this is a small bussiness and it indicated a loss. Right now my boss told me that he can't get 2001 because he filled for an extention until 09/15. How can I go about this guys. I need yr help as soon as possible
 
What you could do is send the copy of the letter/form your employer filling for extension. As long as extension is allowed by the law you have nothing to worry about.

As far as your company losing money, it is in the hands of the immigration officer.
 
I've never seen them say:

"Send tax returns for the years 1999, 2000 and 2001."

In my experience, they always provide options (such as audited financial statements). They need to be sent something of you risk a denial for failure to completely respond to the RFE.
 
Actually that is a very good idea, along with the extension letter, also send some companies financial statements like a bank statement etc.

Actually in the rfe you will see a list of acceptable documents.
 
I'm from a very small company, which had losses too. My lawyer hired his own accountant and gave a detailed explanation on why we had those losses. (Who knows what reasons he was giving ;)). I got my I-140 approved within a month without RFE.
