I- 140 Rfe

Hi all,
I applied for I_140 in March 2003. (EB3).
Just now I got call from my attorney office, and he said I got RFE on my I_140 application
1. Company Tax returns
2. Eligibility to pay wages listed in Labor
3. W2 for 2002 (I think because of this he called me, he asked me to fax….)

First two, my company can take care; my question is about my W2….. Right now I am not getting salary what mentioned in labor. For 2002 W2 its almost 22K difference, for 2003 its 13K diff compared to labor wages. How it is going to affect my I_140.

Is 13K diff is ok, or is it a big issue. Any suggestions……

difference which way? If you are getting more than mentioned in the labor then you will be fine.

Difference is in reverse....I am getting less compared to what showed in Labor

Mine also same case. RFE issued on my 1140, asking about the company ability to pay the salary shown in labor cert. I think, it should not be an issue as long as the company is in good financial position.

It is really does not matter. Your employer is supposed to pay the specified salary at the approval of your green card. They may want to check your working status in 2002.

They might be checking your employer ability to pay.

If you feel not safe then send a letter from the employer stating that he will pay the salary specified on labor at the time of approval.

RFE issued on I140 on Dec 04, 2003

RFE is about my W2 forms of 2000 year since labor subt. used for me was from year 2000. And the company finanical reports from year 2000 to 2003. MY lawer intially submitted 2001,2002 w2 forms and copmany financial reports.

Hi Tammy2,

As I know my company is having good revenue, and profit too.
Coming to me 2002, 2003 I have all pay stubs,, no Gap.....

But still its pain, after waiting for 9 months RFE...

do you have any Idea how many day's it's taking to get approved once we respond to RFE......

When INS ask for a company's past tax returns, could we submit financial statements (assume the company is public) instead?
