I-140 RFE turnaround time

Hi,

I have been in an unfortunate case, where my case is still pending even after 60-70 days of RFE response. My RFE response was received on Novemer 18, 2003. My online status still says, ' On November 18 we received.....blah blah blah'

Does anyone have a similar experince where the case is undecided even after so much time of sending RFE response. What is my best course of action (besides patience, I guess!!) ??
What could be taking so long in my case ?

BTW, mine is NSC center and my RFE was on company financials. Ours is about 90 employee company, with good profit for last 2-3 years.

RFE Reply Received by USCIS on DEC 23. Same message "It will take 150 to ................."

Hi,

Patience is the only way out I beleive. I am in teh same boat as yours. My RFE receipt date is October 29, 2003, yet no response. I have filed for my EAD - 2nd Renewal, hopefully I have been told that will trigger to look at my I140 application..

I replied to the RFE begining of this month and the online status confirms that the evidence has been received. However, the message states" It is taking 350-400 days for this kind of application and since the preliminary process has already been completed it will take less time." Do you guys get the same message? I have applied through Texas center.
 
I sent my RFE response to INS TSC. I get the same message that it takes between 350 to 400 days for processing the I-140... however since prelim processing is done it will take lesser time..

I asked my attorney if we do get a RFE receipt notice. My attorney said NO. As per this thread it seems like we do get a receipt notice.

Someone please confirm!

My attorney says we replied on Feb5,2004. However INS website says Mar2, 2004. Where was my response sitting for 1month?

I have a permanent job offer now from my client company. My I-140 and concurrent I-485 have been filed since Feb2,2003 by my present company using a substitution labor. Is it possible for me to take the permanent offer and leave my current co. ?

Hi,

Yes I have replied my RFE and the message received is as follows :

"On October 29, 2003, we received your response to our request for evidence or information. It is taking between 90 and 485 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case."

Its been now more than 4 months, no approval...

I140 RD : June 6, 2002
I485 RD : Dec 1, 2003
1st EAD : Feb 3, 2003
FP Done : Mar 4, 2003
2nd EAD: January 13, 2004 .... Waiting for approval
 
I have never been so please logging in to Online Case status as today morning. USCIS has approved my I-140 after I submitted my RFE. As per the site USCIS received on Mar2 and they approved it on Mar9. ( I still do not know where did I loose 1mth as I submitted all my papers to attorney on Feb2... BUT now I don't even want to know.)

I wish "Good Luck" to others in the same boat. !

Wow Congrats !!! Good for you. Atleast someone is out of this rut.....Thanks for the update

Congratulations!!!

Does it mean they update the INS online enquiry system every day? (question might sound dumb, but need to get clarified rather assuming).

Please post your RD of I-140 please.

I am hoping to get my receipt in the next 14days. I will post my RD then. As for the system being updated daily my observation is "yes". But let's wait to hear from an H1 DBA working for USCIS.
 
Fellows,

Have been checking the USCIS website for a couple of days and today the status for my I140 stated that the case has been approved on March 11.

RD Dec 15 2003 (Texas Center, Concurrent Filing)
RFE Jan 26 2004
Reply to RFE March 2, 2004
Approval March 11, 2004

The RFE was for evidence that the company can pay my salary and the company replied by providing the Tax returns for the previous year.

How do you find the category? I did not see that on the receipt. I am sure I can find that out from my lawyer but is there any other way of finding out?
