I-140 EB3 Rfe Today

Hi Friends,

I just got mail from USCIS requesting addional Info...

"On May 4, 2004, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer
Service Center at (800) 375-5283. "

Can I do anything to prepare, what kind of RFEs do you get usually? Just company info and such? In how many days after replying do you get an answer from them?

IF any body knows, Please reply ...

The only thing I could recommed based on my personal expreience is to keep your W2 handy and/or may be copies of it.
You are RFE may ask more or less but usually i have seen RFEs for W2 or company's tax papers.

Last week I received an RFE and it was about 2001 W2.

When you get RFE on I-140 and when you respond with the query and say that you would like to consider for the Consular Processing,,...then what will happen to the I-485 and EAD/AP??

I asked my lawyer about ths RFE... she told me, we got RFE with other employee for company's tax papers. this might one of the cases... Also she told me Once we replay ths RFE, we might get approval with 2-3 months... Is ths Correct ? Does it take such long time to Approve ?

I'm pretty sure that to change to CP once the I-140 has been filed, you have to file a form (I-824?). I doubt that you could do this when responding to an RFE and in any case this wouldn't affect the I-140 (which you still need to obtain whether you do CP or AOS). The choice of CP vs AOS is specified at the time that the I-140 is filed (and nowadays, if going the AOS route, most people file the I-485 concurrently).

If you do switch from AOS to CP then I'm not sure if/when you would lose the I-485 / EAD / AP but it would make sense that you would lose this at some point...

Note also that the form to switch can take 8+ months to process although some consulates allow you to use "Attorney Certified I-140" which basically means they can start to process you as soon as the I-140 is available even if the I-824 is still pending.

It is indeed I-824. You have to separately file it(not with RFE).
 
O.K...I will file I-824 along with the I140 RFE??

If so how long does it takes to get I-485? denied? after sending RFE and filing I-824?

Actually, my lawyer also told me it takes 3 mths. Dont know if it's true. One person on the forum got it after 2 wks.
If anyone can verify, it would be great.

It is totally random my friend... I know a case who got his EB3 140 approval notice before his 140 receipt notice (i.e flat 1 day)... So I would advise that do not go by what happpened with others. You may get your RFE in a weeks time, you never know...
