I-140 RFE response sent,HOW LONG is the wait?

I received RFE on my I-140 on 12/15/2004. The RFE was about the filing category , EB2 or EB3 ( strange that they should ask about this now !!!). My lawyer submitted the response and I received an e-mail from USCIS that the response has been received as of 12/28/04.

My question is, how long would the wait be? I have seen that some people have waited for months altogether and others getting approvals within 10 days of submitting the response !!!

My other question is that my EAD expires in May 2005. Is it better to file for a new EAD or should I wait for the response on my RFE ?

Hi Waiting_4gc,

I guess wait after the RFE depends mostly on the complexity of the RFE and the response. Other reason could be the workload on the person looking at your case.

My RFE for 140 was received on 12/27 and I have not heard until now. There has been LUD change on 01/04 but no change in status.

Applying for EAD might trigger the case and you may get approved.

Mine was replied on Dec-20 . Uscis recieved it on Dec-23-04. No updates from that time. I dont know how long it will take.

Response to my RFE was received by USCIS on 12/08. I have not heard anything back yet. I called the 800 number on 12/30 to check on the status and was advised to wait for 60 days from 12/08. Incidently LUD changed on 12/30 for my 140 and 485 applications.

My RFE was responded to on 22nd Dec. My case was approved on the 29th. So the wait was only about a week (that too during the holidays). Note that my case was EB2 concurrent filing and hence, fell under the new CSC pilot program.
