Hi Friends,
I have a unique problem.

My Labor was approved on 23rd Feb. 2006
My I-140 was filed on 13th July, 2006
I got RFE in I-140, I am working on it [I have to answer it till May 15, 2007]

It looks like that one possibility is of getting denied of my I-140.

My 6 years of visa expires on Aug. 2007 [after 4-5 months]

if my I-140 is denied, then::::::::

I want to stay little longer [around 6 months or 1 year] legally in USA.
WHAT ARE MY CHANCES, how can I stay.

[I dont want to go to home country for now] Is there any suggestion.....

thank you friends....

Rfe

For anyone to give a reasonable suggestion, please explain the RFE.
There are excellent people on this forum, give it a try first.

My I-140 RFE explains as below:

I am permenant employee of the petitiioner/employer.
My employer is not able to pay me defined wage. I am under paid.
My yearly wage is 50,500$, but in 2006 I was paid only 18,900$.
[my proffered wage is 90K.]
[INS tells that petitioner FAILS to establish that petitioner had, and continues to have, the financial ability to pay the proffered wage of 90K as of feb,07]

* INS as asked for 2006 employer tax papers. [company is doing loss & have very low gross sale]
* I have my current pay stubs for 2007 [as per 50,500$ wage] which I can show.

but but but, my employer is not sound enough financially to establish that employer is able to pay me proffered wage.

can you help me find solution...

thank you a lot.
