I am a PhD in Emory University, doing AIDS vaccine research. Have 12 papers, 8 citations (most of them are cited by my own group).have 5 reference letters, one of them is from indepedent reference. Filled I-140 on July13, and got the RFE on Sept, 06,05. The following are the major points of the RFE:
1) The letter first mentioned the Matter of New York State Dept of Transportation case, and talked about the factors need to be considered regarding the NIW.
2)Then it says the evidence that I provided has shown my research has substantial intrinsic merit, and the Services finds I meet the first prong of the NYDOT and is in area with substantial intrinsic merit. Further, the evidence submitted shows that my proposed benefit would be national in scope.
3)However it asked me to show that the labor certification process would adversely affect the national interest.
4)it asked me to provide evidence from independent research sataing to my comtributions in HIV vaccine researchand theimpact my research has had on the field.
5) Since most of my published papers were cited by our own group. it asked me to submit evidence of the extensive and frequent citation of my research. The problem is our research is developing AIDS vaccines by using replicating adenovirus as a vector. This strategy is limited to our group due to the patent.
