I-140 -RFE - I nned Advise, pls.help !

Hi, I am Ganesh,
Recently, my Employer told me that they received a RFE
For I-140, requesting for My Credentials again, since my ealier
Lawyer put my application in Masters catagory, which was wrong.
I got approved from Labour cert. but now I don't have
8 years. of work Exp. to show as of my first filing date in April 2000.
I had 2 bachelor degrees ( 18 yrs ) and the courses I did
from India for compt. science. +plus about 4 yrs. exp as of 2000
when I filed my Labour Certif.
What should I do ? Should I start my Process all over again ?
Or can I take my 2 bachelors degrees +plus 4 yrs. exp
as of 2000 to evaluater and get it approved as masters ?
I came here in April 1999, I have my H1 visa approved till
2005 only.
I am totally lost .........!
Can someone help me ?

By RFE on credentials I am assuming that the NVC wants you to state how your qualifications match those mentioned in the LC.

I have the following question for you.

Is this an LC substitution case? Because only in the case of
substitutions there is a chance of mis match between the LC and the actuals.

You will have to take a close look at the following 3 areas:

1. Educational requirements: Check whether your qualifications as on the date of filing the LC are the same as mentioned in the LC. Check whether words like 'similar' or 'equivalent' are used.

Also check whether it says, work experience can substitute a degree.

2. Work Experience.

Check whether you have the same work experience as on the date of filing the LC.

3. Additional qualifications

Check what is mentioned here.


To recap, it is essential to prove that your education, work experience , and other qualifications are similar to that mentioned in the LC.

You will find all the above information in the LC copy

If necessary get your educational qualifications re-evaluated.
Get new experience letters , with the job duties fully explained.
