I-140 RFE - help please

Hi,

I had my labor approved from VSC and filed for I-140 in CSC as
I was working in CA when I filed my I-140. I moved out of CA now
to WI and the CSC came up with an RFE asking for two things:

1. Employers Financials - I do not see any issues here
2. My Future Employment Location in CA(or CSC area)
   Since the labor was done from VSC will there be a problem
   if my employer says that he intends to employ me in some
   place in CA(say SFO). Will they reject the case or Will
   they transfer the case to VSC ?

   Has anyone been in this kind of situation before ? Any help
   or advice is greatly appreciated.

What u mean by VSC?? There is no such labor approval from VSC... discuss with your lawyer.

 
 
If I understood it correctly .....

Sometimes INS ask for some stuffs even though that does not make any sense at all.. So submit your company financials again. If your company has more than 100 stuff, a letter from CFO will suffice, or get last two years tax returns...

About the location I think you need to talk to your lawyer.. Where is your company HQ?? If it is in CA, just tell them you want to work there.. I am seeing three possible outcomes..

They may approve it right away, this could be a simple formality...

Or, they may say that since your labor is from region I, you can\'t file 140 in CSC.. As far as i know, labor certification is processed based on the specific areas.. You know salary and demands varies across the regions... So my guess, your I-140 should have been filed in VSC....

Or, If you say you want to work at region I, then your case may be transferred to VSC.. VSC is processing 140 very fast.. Probably in less than two months...

LCs are location specific, at least unless it\'s set up otherwise

This is one reason why consulting firms often file LC\'s for the corporate headquarters "and other unanticipated client sites throughout the US." If it\'s filed for a client site only, and that site no longer exists, the LC is technically invalid.
Depending on what happened and how the LC was filed, you may have a serious problem going on.

LC was filed for NJ(company HQ) and other client sites

At the time we filed 140 the attorney said that we have
the option of filing 140 either at CSC or VSC and we
decided to go with CSC as we saw that the processing
times were better at CSC that time. I guess that was
the mistake.
