I-140 RFE - Educational Qual

Is anyway i can know what is entered in Column14 and 15 now.
I don't what is entered then.

There were no computer courses in degree. I am totally dependant on my certificates. Is it something wrong done by my attorney while filling up 750a?


I do not remember sending transcripts for GC evaluation. My company might have these at the time of H1 filing.

I am on EAD (went for 7th year extension before getting EAD) now. Am I still eligible for 8 th year extension after filing for appeal if it I140 gets denied? Can one go for another labor during these extensions?

I will ask my company to send me evaluation report.

The ad for labor says B.E CS or equivalent or any degree with expereince.

But 750a said the following.
14. Bachelors Degree or equivalent in Computer Science/Related field
and two years of work experience.
15. Knowledge of DB2, CICS, PL/1 and SAS.


The ad is correct.But 750a seems to be wrong.

Guys, I am also in the same boat, I am BE Mech/ME Prod waiting for my I-140.
Is the RFE's specific to any particular service center. After waiting for long this news scares me.

RFE issued on I-140.

Guys,
I am bumping this thread up as I have a similar RFE issued on my I-140. Could guys who have replied to the this kind of RFEs before post their updates as to what is going on.

Here are my details:
I-140 and I-485 ND and RD are 09/30/2003
Last update date changed on 05/26/2004 for I-140
Again changed on 06/08/2004 for I-140
RFE issued on 06/07/2003

Haven't received the RFE yet, but I am suspecting it will be on education as I have a degree in Mechanical Engineering too.

I want to know what was stated in the labor (education required) for the ones who received RFE.

Mine:
Education: Masters* in Engg or Comp Scien or Math
Experience: One year in computer related field.

*It is also stated that Bachelors plus 5 yrs of experience will be considered in lieu of Masters.

Please share your details too.

Has anyone in similar situation get an approval after replying to the RFE?

This is what I got: Please share your info. as my cousine is in the same boat.

My cousine's I 140 is denied and with our luck they mailed the papers on 5/17/04
but my lawyer's partner was in China and held all his mails. His partner just
came back to office on Friday and we got the rejection letter. But we only have
until this coming Wednesday to reply as BCIS only gives 33 days to respond and
we lost most of the time waiting for the letter.
The reason for denial is "BS is not in the Computer Science" eventhough labor
advertisement never put that requirement. My cousine has Bsc/Msc in Botany from
India and has been working in computer industry for last four years. He is MCSE
and also has taken lots of other computer courses.

1) Is there any way to get more time from BCIS to appeal?
2) Anybody in the same boat, please share your experience about Education
equivalent.
3) Any help, anybody can give me, will be VERY VERY MUCH appreciated as
I'm running out of time and loosing my sleep over this

I have received an RFE on I-140 for Education evaluation and experience.

Details:
Labor filed EB2 August 2001.
I140 and 485 concurrently filed on 09/30/2003.
RFE issued on I-140 06/07/2004

Labor says
Degree: Masters*
Major: Engg or Comp Scie or Math
Experience: one year in the computer related field.

*Bachelors and five years of experience will accepted in lieu of Masters and one year of experience.

I have a Bachelors in Mechanical Engineering completed in Jan 1996.
Experience from Aug 1995 to July 2001.(6 yrs).
5 months of Experience is before the degree was awarded.

Question:
Can the experience before the Bachelors degree was awarded be counted towards the labor?

I spoke to a person in my lawyer's office and she says that as the Labor specifies, Bachelors with 5 years of experience will be accepted in lieu of Masters and one year of experience, they did not submit my experience letter which was before my degree was awarded.

Would any of you know if Bachelors with 5 years of experience can be submitted for Masters and one year of experience? Would BCIS be convinced with this explannation?

Should I ask my attorney to submit even my prior experience letter which was not submitted during initila filing? Would that raise any questions?

I send my Education Evaluation and all my certificates ( incl B.Tech, Intermediate & SSC) photo copies. INS received my RFE on June 1st 2004 and Approved on June 11th 2004 . Today I received my mail.

You mentioned that you submitted a new B.Tech evaluation for the REF and later 14o was approved. Could you please let us know that what the difference is between the OLD degree evaluation (submitted with 140) and the NEW degree evaluation (submitted for REF)?

Is it that the NEW evaluation mentioned that the degree is POST-SECONDARY (post high school) while the OLD evaluation did NOT mention this point? What are the other differences?
