I-140 Rfe complicated???, salary less then specifed on labor?

RFE: Companys Ability to Pay for the labor approved salary

1)My labour was mentioned with $70,000 salary by mistake from my attoney, but my W2 was showing 56K per year and also paystubs was also showing less than what was specifed in the labor. What I did was I was taking the salary as $56K per annum in the paychecks and the remaining amount as expenses per month.


2)Also in my year2003 -W2 form, I worked for the company A who have filed for my greencard from JAN TO NOV 2003, But in the month of December 2003 I have changed to company B based on my EAD without applying AC21 and before my I-140 approved, Now my Year2003 -W2 form from company shows from Jan to Nov 2003 but if they request my 2003 -W2 filing statements then Company B names is listed for the december month?, If so will the USCIS will state query and can find out that why did I have joined in company B? before my I-140 is approved and deny my I-140???



Gurus please advice??

Your lawyer should get in writing from your employer that they will pay mentioned salary once your GC is done.

Do you think that will solve the problem???, If my employeer write a letter saying that he will he will pay the salary specifed in the labor will be paid once the GC is approved??
 
Calm Down

Calm down. It does not matter at all, if your previous employer does not withdraw I140 application. If you get an RFE you need to send them latest papers with AC21 ( Hire a good lawyer )
 
my employee of company A who is sponsering my Greencard is able to support my financial documents...but the question is the RFE clearly says that my salary on W2's for 2003/2004 is $18k less than what is specifed on the labor...Please let me know if my I-140 will be denied or not??.
