My Labor was filed with Company name A. My I-140 and I485 was applied with Company B (Company B is d/b/a Company A and is a fully owned subsidiary of A). In the ability to pay company B has mentioned that Company B is fully owned subsidiary of A.
I got an RFE on I-140, asking to prove successor in interest
asking to provide
- Uncertified ETA 750 with Company B
- Proof that Company B has been transferred all assets,liabilities etc.,
My lawyer has replied saying that Company B is not a succesor of interest of A but is doing business as(d/b/a) Company A and that there is no merger etc,involved in this matter. Basically Company A is a trade name used by company B.
Please let me know if a wholly owned subsidiary d/b/a the company that filed labor apply for i-140. Are there any problems in submittine uncertfed ETA 750 with company B?
