I-140 RFE/Cancel it and reapply I-140...???

Dear Gurus..Please advice !! (Jharkhandi,,,,Usnysys,,,...Realcandian ..or others...please advice)

I got RFE on I-140 which I have filed concurrently last year along with I-485.

Due to personal reasons I would like to cancel or not to respond to the I-140RFE..and which will deny my I-140 and I-1485. I have H1B1 till 2 years and I want to know the procedure involved in re-apply the I-140??

Please help me these questions.....I don't want to go back to why you don't want to reply to RFE...Well..its gone ....I am only intrested in how to reply apply I-140 fresh again...How can we do this???

1) Does we need original labor re-apply the I-140?, If so where can I get this??, Do you want me to respone to the RFE saying that Please send me back my original labor?? If so I long does it takes for me to ge the original labor??


2) Can I reapply and mention that my previous I-140 was denied and USCIS has my original labor approved and can I re-apply I-140/485???...Please advice...

3) Please advice how to re-apply I-140 refresh again??

To answer your questions, let me know what the problem is for you to answer your RFE??

Its always better to respond to RFE rather than filing in a new application and getting into the queue all over again.

I guess you cannot use the same labor to file a new I-140. Even if you are filing your I140 again, you need to mention on the application your old I140 number.

Since you stated that you have 2 years left on your H1B approval, I guess you still have time to get into the queue and start your I140 again, but dont you think responding to RFE is much easier..

Can I also know what your RFE states, maybe it might throw me some clue..If your company has additional labor for you, maybe this time you can use that and file your I140 all over again.

Hope it answers. I would welcome other Guru's suggestions too..
