Hi all (to whomever it may be applicable)
The news is that if INS does not receive a response to an RFE within 72 business hours. it treats the response as being recd. after 87 DAYS (may be business not sure) even though the response would have been recd. in a week's time. It is only after 87 DAYS that a new (if available) officer is assigned to the case and then it takes the normal 60 -75/90 days of processing for the RFE atleast in I140 where the message says 150-180 days. So make sure the response is atleast faxed first within the 72 hour limit if possible.
if these are business days then we are looking at more time.
Also based on some of the spreadsheet and my own R&D I found out this to be true hence some people get their approval within a week after they send the response as this would have been sent within 72 business hours. so that the officer currently working on the case completes his task before putting it in whatever list that makes the case pending.
( I ain't a lawyer just one of those H1 B guys. but thought would pass on this Info).
