I -140 processing -Vermont processing centre -people have lost there mind

Hi Forum members,

The Vermont centre way of working reminds me the Muslim king TUGLAK.

My I-140 case has been pending over a year i see cases filed months after my case are cleared ,

But regarding my case i keep seeing the stupid message it is still under processing.

This is one department in the US who have no work ethics .

I am getting sick and tiered of the Vermont centre whimsical ways
of working in clearing I -40 cases.

pending I-140

Hi,
The notice date on my I-140 is 10/24/2002 and it shows
up as still processing on the INS website. The current
processing date is March 08 2003. I have no Idea what is
happening. My lawyer has contacted the Vermont Service
Centre and they are looking into it. I am anxiously waiting
for their answer.

What is your labor receipt date/riority date.

They may be processing based on priority dates

my I-140 receipt date is 10/21/2002
and the notice date is 10/24/2002.
The Vermont centre is processing May 8th 2003 cases,
In my case even the 465 days waiting time is complete.

There was rumor that CIS is processing on US arrival date.

On serious note nothing make sense. I know couple of cases which are pending since June 2002. It is really bad.

I-140

I have a similar case. Still waiting for I-140 even though the processing data release for Vermont on 03/22/2004 says that they are processing application as of March 12, 2003 for Advanced degree or excpetional ability category.

Lets hope for best. I called them up and they said ask your employer to issue a case status inquiry since its passed the released processing date. Not sure if that is going to make a difference. I would give it another month and see how it goes.

My Eb3 is pending since March 7, 2003. My lawyer has called USCIS and opened case query but the have not responded yet. Not sure what is going on.
 
They are just playing with dates,those dates out there does nothing good other then giving us kind of false hope, I know few people from y company who applied there i-140/i-485 in as early as may/june 2003 and have not even got EAD,on same hand another woman from out company who is a recruiter and filed her GC under eb3 got her i-140 approved after filing in october.

VSC is like a hell,it is just like lotto.

mine is pending from sep 2003, i know it is not that long but def we feel cheated when we see people after our ND get proceesed.

mine is labor subsitution and it may or may not get approved, to be honest with u friends, I am fine if they wanna denie me, bad thing is thay are killing my time, not to mention that urs also.

they are just screwing our life.

AS frustrating as it may seem to be...I do believe there is a logic behind the processing times and the order in which they are being processed.

time and again, CIS website says applications are processed in the order in which they were submitted to the service centers.

Regarding I-140 for EB2 (or EB3 for that matter), it does seem to be erractic. The following were thought to be the reasons by GURUS. I just think it may be something do with the STATE LC filing date.

1) RFE cases get approved faster (maybe true based on approvals)

2) EAD triggers I-140 approval (BULL)

3) AP triggers I-140 approval (a Joke, isn't it?)

and many more creative thoughts on earlier approvals that I cannot seem to remember at this moment. But these creative thoughts provide nothing but pure entertainment and maybe just wishful thinking on the part of an optimistic applicant.

As usual, I am with you manoj. My case is also pending since June 2003.
Now the issue is with the employer. A lot of people have filed cases on my employer for not getting paid in the past 2-3 years. Recently, the employer has lost the case against labor department. So, it is in red now...high alert for USCIS probably.
My labor was filed 3 years back and 140 in June 2003.
My attorney has told me that most likely I would get RFE for company's capability to pay, which the company would not reply as it can not justify not making payments to others and claim that they would pay me.
So, I am likely to get a denial mainly due to long time taken by USCIS. I do not have issue with finding a new job but it really kills me that I would have to go thru the GC pains (Now growing bigger with time) again.
And I am ready for denial. The aspect of waiting against hopes that it would get cleared sets in more frustration. Decision in time, whether denial or approval, helps to take better decisions and corrective steps.
USCIS would never get that, cause they do not lose anything in it. It is our pain, which they probably do not care.

I am new to this forum. I have a question - if one has received an EAD but I-140 and I-485 have not been approved yet, is it OK to switch jobs? Or be laid off and look for a job (seems like its gona be my case).

Is it OK to switch job?

No. Wait till you get I-140 approved (by the time you will also be crossing 180 days).

Do not change jobs when your I-140 is not yet approved

Hi Kosian,

Welcome to the forum ,

Please do not change jobs while ur I -140 is in process .

You can change clients if ur GC sponsored company sends you to diff clients for work .
But do not change the GC sponsored company until u see ur I 140 approved and ur 485 is past 180 days .

Thank you guys for answering. I would like to keep my job until getting GC but what if I get laid off? Assuming I loose my job and have 180 days but don't have I-140 approved what might happen to my case? Is there any chance of getting the GC sponsored by the old company and working for another company with my EAD?

(If not then I really don't understand the use of EAD)

We all all with you. Hopefully BCIS does something to speed up the cases, it's getting on everybody's nerves. All our lives are hanging by the stupid bureaucracy. Is this what democracy is all about? Red tape and bureaucracy!!
