I-140 problem

All,

My company filed labour with following requirement.

MS or bachelor with 5 year of progressive experience.

I have only 4 year of experience when I joined my sponser company.

I am working with my gc sponser company from last 4 years.

So total 8 years of experience. My question is Whether BCIS
consider my experience with current company or not.

Please suggest what are my options.

It is not clear from your post whether you are trying to use
a labor that the company has and which was obtained for
another person.

If that is the case you are supposed to have the necessary
experience and educational qualifications as on the date of
filing of the LC.

The experience you have gained with the GC sponsor is not
counted.

If on the other hand the company has filed a LC application on your behalf then the question, why they mentioned 5 years
instead of the 4 years you have?

You have not stated whether you have MS or not.

Can a part-time experience be counted towards experience when using a substitute LC??

What does progressive experience mean?? (Is it without a break or something else....can you shed some light on this....

No, full time experience is needed.

It means you have been gaining the experience in the same field as you are progressing in your career.

For example: You have been working in Oracle Software projects from the start of your career as a Trainee Software Engineer, and now lets say after changing couple of companies and gaining experience of 5 years you still work in Oracle but with more responsibilites and may be with title Senior Software Engineer.

Then you can file a 140 for a Software Engineer position with Oracle Skills using this progressive experience.

The BCIS wants to see Oracle in all your experience letters that you submit as proof of progressive experience.
