I-140 premium processing

I have got my I-140 converted to premium processing. But there is no response even after 2 months.
When we called USCIS, they said the file is not with USCIS and it is with some other department for name checking and they can not make any decision unless it is released from that department.
Actually name checking is required for I-485, Not for I-140.
I have done concurrent filing of I-140 and I-485 in texas service center.
Why are they doing back ground checking during I-140 stage?
I want to know if there is anyone in the same kind of situation or if it is somehting abnormal that is happening?

You made $1000 check for premium processing payable to USCIS or "US Department of Homeland Security"?

I sent the check to my attorney. She paid to USCIS. I don;t know how she made the check paybel to.
However, we got a reciept notice from USCIS, saying that my I-140 got converted to Premium processing. Only thing is they have not taken any decision on it even if after two months.
