Hello,

Does anyone have any information if USCIS will resume I-140 premium processing anytime soon? Thank you
 
they announced the extension of suspension two three weeks ago. no one knows at this point. i am monitoring it closely. i will let you guys know asap. before you decide premium processing, make sure the priority date is going to work for you. if you are EB3 and you just got your LC, there is no point to pay 1000 since the EB3 wait time is 5 years.
 
Hope they start PP soon.I am on my 6th yr on H1. My PERM will be filed in Oct and my 6th yr on H1 is ending in JUne 2008, so effectively I dont have much time left and premium processing is the only option which can help me get the 7th yr extension .....wait wait wait

sadly immigration is pretty good at ruining people's life. but dont worry about 6th year ending. since you have a I-140 pending you can file an additional 7th year extension until they reach your I-140. all you have to do is pay for the fees which is pretty high. :eek: hopefully you get your answer soon enough
 
Sorry to contradict ... how can someone file a H-1B extension if LC was not filed at least 365 days earlier? The other clause is I-140 approved and I-485 cannot be filed due to retrogression.

i havent seen a 365 day filing in the immigration handbook. immigration knows the EBs take quite sometime and in order to ease the pain on US employer, they allow 7th year extension so that employee can stay and work for the company.

Yes correct I cannot.That's why I need the I-140 approved to get a 7th yr extension
