My I-140 is pending for more than 180 days.
I know there are so many people waiting for even more..
If some one have info, Please inform why INS (vermont ) center is delaying I-140 cases (especially non concurrent filings)...
is there any freeze on it?
If not when can we expect,it will move on???

Why no of I-485 approvals are much more than I-140 approvals (hardly one or two in a month). What's happening? Any reason?

I heard something like its slow for non-concurrent filers atleast at VSC. Going concurrent may help to expedite. Is there any reason you cannot file "concurrent" at this time?

rdip,

The only reason why did not go for concurrent filing is AC-21 portability.
My lawer has advised me at the time apply for I-140 that If I go for concurrent filing, there would not be AC-21 portability..

Now after this much delay, now he is inclined to go for concurrent filing(because of the delay)..
now i am in dilema whether to go for concurrent filing or to wait for I-140 approval...

Thanks

I am not sure about the AC21 portability as its not an issue in my case. However, I have heard from a couple people that even if you file concurrent now...it should help to overall cutdown time on your 140 processing (I think its because they will do the provisional check on the 140 within 60 days after you file concurrent)........on the other hand not filing concurrent may give solo 140 filers the least priority for processing (given that the concurrent filing option is in place)
(N.B.: 'am not a lawyer...so its not a legal opinion....but STRICTLY word of mouth)

I-140 ND 7-19-02

Hey folks

My EB2-NIW was filed on July 19th 2002. The Online status still says "it is taking between 90-180 days" , the IIO has told the lawyer " Homeland security is top priority" hence the delay. This statement is not consistent with the fact that people who filed in October or even in Nov of 2002 have received approval notices. But it has become clear that concurrent filers are seeing rapid results (relatively) as compared to solo filers.

I have decided to proceed with filing my I-485 in order to expedite the I-140 processing. It is a risk because if I140 does not come through I may loose the $ 1200 that I am paying the lawyer for I485 filing. After a long wait I think the risk may be worth it.

All Comments are welcome.

Thanks
