I-140 pending for more than a month after RFE

I filed concurrently I-140/I-485/I-765 using substitute LC from the company (category: EB3) in VSC

RD for all three cases: 03/26/2003

RFE was issued on my I-140 (RFE date 04/25/2003) for name spelling and section change on I-140. BCIS was wrongly put my I-140 under EB2 section (even though we filed under EB3) and spelled my name wrong and they issued RFE on it to get evidence. Replied RFE in 2 weeks and online update shows they received it on 05/13/2003

I heard VSC-BCIS usually takes 3-4 weeks to decide on I-140 RFE situtaions, and i read the same for some EB3 applicants got approved within 3 weeks after their RFE in this same forum. But mine has already passed 4 weeks and no response yet from them.

Does anybody is in the same situation, could you explain how the I-140 RFE cases will be processed based on EB2 , EB3 & LC substitute?
and usually what is maximum timeline to adjudicate in this situation?

I called BCIS last week for my EAD status (90 + days), they said my EAD is been pending on my I-140 case to process first and they make a decision on my EAD after that.

Can i eligible to apply for Interm EAD at local BCIS office in my situation?

My RFE was received by BCIS on May5th and no response after that. Mine was a LC Substitute and they wanted to verify my experience letters. Did they said on ur RFE notice that a minimum of 15 days and max of 60 days time will be taken for this kind of case.

Can any one say whether i can go for interim EAD. My receipt date for 485/EAD/AP is 02/10/2003 while RFE issued date is 04/15/2003 and RFE receipt date is 05/05/2003.

Did you file your I-485 after filing I-140. If so, please post the details such as record date, notice date, first 10 digits of your I-485 application.

Seems they are working and may be backlogged about 2 months for looking into RFE cases

kkulkar : what is that they want to verify in your experience letter ? Didn't you submit them while you applied your I-140 ?

I dont know what they mentioned about timelines in my RFE, because I-140 owned by employer they dont really give much details about it unless they need something from the beneficiary!!

About your EAD , i guess local office usually makes decision about that once they talk with the service center people. Everybody case is different.

I Queried few attorneys on the same issue, they all mentioned that there is no such rule that they hold people for EAD issue at local office. But it all depends on what BCIS decides

Trying will not harm anything if you are close to local office and in hurry to have one
