I-140 pending, can spouse use EAD to work?

Dear friends,

I filed I-485/EAD/AP to NSC together with my wife. ND: 10/24/03

I am using H1b to work and my wife is H4. My wife got a good offer but the employer would not sponsor H1b for her. So, is it really risky if she uses her EAD to work? My I-140 has been pending since 8/26/03, EB1-OR, NSC.

wait till your I-140 gets approved, if she uses EAD she will not be on H4 status. I hope i replied to your other post in detail
