Here is the case:
2008/01 I-140 Registered 20-year-old
2010/02 1-140 Pending 22-year-old
For some reason, I-140 is pending for 2 years. I-140 is registered under parents name. At the time turning in I-140, the child was 20-year-old. And, now the child is 22-year-old. In this case, would child be protected by CSPA(Child Status Proctection Act) if I-140 get approved now?
Another question. I-140 is filed for EB-3 other worker as substitute case originally(2007/7) and it was not filed first because of lack of document. Then, the lawyer proved that the case still valid and USCIS filed I-140 with the new date(2008/01). Is this suspicious that the lawyer is lying? Can this ever happen? Would ever I-140 pending for 2 years in this case?
