I-140 opt for CP, but got approval for AOS

Hi,

When I filed 140 my lawyer indicated CP, but TSC approved it for AOS instead (after 8 months of waiting). My lawyer called them last Tuesday about the mistake. I am wondering if anyone has the simaliar problem. How long will it take for TSC correct this kind of problem and to send my case to NVC. Any suggestion on what else I can do about this? Please advise.

at new Delhi consulate. It was accepted

I had similar issue with VSC.

The lawyer took lot of time to call them but they corrected it quickly and senta new approval notice. If teh lawyer had used the old I140 application form it is ambiguous and so it seems that they need to mention it boldly on the front page that it is for CP.

 ANyway which consulate are you planning to go to in India. Bombay accepts AC140 (attorney certified..) So you can apply for CP rightaway. Chennai doesn\'t accept Attorney certified I140.

Does Mumbai Consulate accept E3 cases for AC-140. My I-140 got approved and I am planning to file for I-824 and then send P3. Would you throw some light on this.

bad habit of TSC

The problem of I-140 approval for AOS even when CP was clearly and explicitly requested is a recurring one with TSC, in fact they are notorious for it. I had this problem and ended up wasting almost 6 months waiting for TSC to correct their mistake despite many attempts by my lawyers to get something done. Finally I woke up and realized there was no point waiting for these idiots to do something and filed I-824 as if I had requested AOS from the start and now wanted to change. Upon receipt of filing I-824 it is, at least in theory, possible to send it along with the other packet 3 materials directly to the US consulate in the last country you resided in (UK in my case). Note, this is not quite the same as AC-I140, the attorney does not need to certify anything because the I-824 receipt is the key document. I am still waiting to hear about an interview date from the London consulate so I can\'t directly confirm that this procedure still works although I have no reason to think otherwise.
 
I had the same problem at TSC ....

so my wife called the IIO and got it corrected....it took 2 days for them to send the new I140 !!!
 
I forgot one more thing ...

The IIO himself called my lawyer to oppologize for the mistake and verified the lawyers address too !!!

Looks like TSC is improving ...GOOD LUCK !!
 
Thank you for the advises, I am going to do AC140

I will do CP at consulate in Guangzhou, China, which accepts AC140. I am now preparing the documents for AC140. What kind of documents you guys prepare? My lawyer mentioned the followings:
1. DS-230 part I.
2. Copy of passport,
3. Copy of Birth Certificate,
4. Original 140 approval notice.
