I-140 longer than 300 days

I think that 10 months equals 305 days. While ago people were suggesting that INS is talking about business days ... Then 300 days actually equals about 415 calender days (including some holidays). Where is the right answer?

EB-1
I-140 ND 4/25/02
I-485 ND 8/28/02
EAD AD 9/24/02
FP10/28/02

When I filed my I-485, my lawyer did the days calculation for me. My I-485 is filed in 9/26/2002 and he said that it will be 180 days by April this year. He also calculated the days based on Received date, not the notice days. So, I think it's not based on business days.

You can also call the National Customer Service center: 800-375-5283 on immigration matters. I did call once and it seems like they will guide you about immigration information.

From what I have learnt from from my company law dept and other sources on the web (like the FAQ on Murthy.COM), what MM110 says is correct.

The number of days mentioned by INS in their monthly Processing time report is the actual number of days (including weekends and holidays) and not business days!

I-140 almost going to be one year

Hi Guys

My I-140 was filed on Feb 22 2002 and still I didn't hear anything.
(EB1 - VSC) I already filed I-485 and got my AP and EAD approved.
When our attorney contacted INS they said the file is with an officer and they told us to wait for few weeks (already 4 weeks gone). Thanks to concurrent filing, I could get some relief.
Still a long way to go.
Any guys still waiting for I-140 approval for more than 300 days?

What happened to June applicants (like me) and my earlier applicants???? Incidentally, today i am entering into my 10th month of filing 140.....

Aibility Worker
and some other subcategories that I don't know :p

Our lawyer told us the FBI check was 60 days. After the 60 days, she told us that they were 75 days behind. Has anyone heard such thing? How can you ensure the FP check is over and/or that your case is being worked on?

Here's my 2 cents worth

Take my word for it....that 60 days will become 75 days..then
100 .. then 125.. then 250.. then 500.....

Here's my projection..... these guys will make I-140 take such a
long time ( my estimate is > 900 days ) so that a bad economy
ensures that its enough time for a guy to be laid off......
which in turn means that INS wont have to handle that I-140....
just rely on the guy to be laid off so that the application
needs no handling...
i must say that's a very intelligent strategy.
 
365 days now and I have not heard anything from VSC yet...

I have not yet received any information from INS on my applications. The current processing time indicates that they are processing July 2002 cases. The thing that is of most concern to me as why have they not issued an EAD to me yet. INS is so inpredictable.

Just looked at California and Nebraska Centers processing updates, and got a deep feeling of being completely screwed by Vermont. It is at least 6 months difference in processing times of EB1 and the gap is getting wider and wider. What is more troubling that during March very few people posted information about approval of I-140s.

Is it something about popularity of this forum or Vermont Center is completely stuck?

I absolutely agree with you. There are something wrong in Vermont that we don't know. Looking at EB1 and NIW case, seem there are nobody processing those case since March, 2002.
