I-140 is still pending

Already I finsihed 380 days successfully.

JULY 8th notice date

Which number should I call to Enquiry about I-140..
some body said in the forum we have to call and we will give all the details like Recipt# and etc..
Please provide tel# and what details we have to priovide
please advice.

This is atleast 5th post I have seen from you asking about what to do. I guess no body has a clear answer to that. Your best
options are the following:

1. Call National Customer Service Center (800) 375-5283 and ask for the case to be investigated.

2. Ask your lawyer to get involved and pursue the matter further.

To ease your pain, there are still people waiting for approval with
ND as back as in May 02. So it's not like your case is something to
panic.

Here is an excerpt from the RFE:
"If you are willing to change your request to second-preference " advanced-degree professional" classification with a national-interest waiver, we are willing to approve the petition for that classification, with no additional evidence of any kind. Such a change would produce no disadvantage to the beneficiary in his pursuit of permanent resident status. Please let us knowwhether you are willing to change your request to second-preference advance degree professional."

I understand that there has certainly been erratic processing time as far as the VSC is concerned . But I would like to know if EB3 categories take longer time than EB2's . Or where in he GC processing do they differentiate between and EB2 and EB3 .

With all the employment based PDs are all current, it does not matter its a EB2 or EB3. Couple of years back, espcially for India and Philippines, EB2 used to be either current or very little lag in PDs and EB3 used to have PDs back two to three years. So once I-140 is approved, EB3 guys used to wait years together to apply for AOS/I-485 as one can apply for I-485 only when the priority dates for the category is current. In that scenario, EB2 was hot as it cuts down lot of waiting.

If some get this type of RFE, what is rate of success for approval. How many days usually it takes to approve the case after replying RFE.Please reply my mails, if someone has gone through same pathway.
